1. Purpose

This page explains ASK’s security posture, vulnerability reporting process, and important limitations concerning Site content, provider admission, and provider engagements. It supplements the Terms of Service, Privacy Policy, Cookie Policy, and Acceptable Use Policy. The Acceptable Use Policy defines prohibited technical and nontechnical misuse. If a binding provision conflicts with this page, the applicable accepted Terms control to the extent permitted by law. This page is governed by Kentucky law as described in Section 56 of the Terms of Service.

SECURITY

2. Security Program

ASK maintains administrative, technical, and physical safeguards designed to be reasonable for the nature and volume of the information ASK processes. ASK’s security program is intended to include access control, authentication, vendor management, risk assessment, staff training, secure disposal, incident response, and safeguards for transmission and storage appropriate to the data involved.

ASK maintains or will maintain a written information security program before accepting live provider intake data and will review the program as technology, vendors, data, and risk change.

Specific technical controls change over time. ASK does not publish a detailed list that could create a false security representation or assist an attacker. Statements about a specific control should be published only after ASK has verified that control is actually operating as represented.

3. No Absolute Security Guarantee

No website, database, cloud service, network, device, transmission method, or security program can guarantee prevention of every unauthorized access, attack, interruption, vulnerability, loss, or misuse.

ASK does not warrant that the Site will be uninterrupted, invulnerable, virus free, or immune from third party attack.

Users are responsible for the security of their own devices, accounts, networks, credentials, email, and provider systems. ASK may rely on hosting companies, email providers, payment processors, security vendors, analytics providers, AI or software vendors, communications providers, and other third-party systems. Third-party outages, errors, attacks, deprecations, configuration changes, or failures can affect availability or security and may be outside ASK’s direct control. Nothing in this paragraph limits a nonwaivable duty applicable law places on ASK for ASK’s own conduct.

4. Vulnerability Reporting

If you believe you found a security vulnerability affecting ASK, email support@asktheconsultants.com with enough detail for ASK to evaluate the report.

Do not access, alter, download, retain, disclose, or delete information belonging to another person; degrade the Site; conduct denial of service testing; use social engineering; introduce malicious code; or perform testing that violates law or ASK’s Acceptable Use Policy.

A vulnerability report does not authorize testing beyond otherwise lawful access, create a bug bounty program, grant safe harbor, waive ASK’s rights, or authorize conduct prohibited by the Acceptable Use Policy. ASK does not operate a paid bug bounty program and does not promise compensation or a particular remediation timeline.

ASK may acknowledge, investigate, prioritize, remediate, or decline a report based on its assessment of the issue.

5. Incident Response and Breach Notification

ASK maintains an incident response process. If an incident involves regulated personal information, ASK will evaluate applicable federal and state law, the residence of affected individuals, the nature of the information, and applicable notification duties.

All fifty states have breach notification statutes, but their triggers, deadlines, regulator notice requirements, and definitions differ. For Kentucky residents, ASK follows KRS 365.732. For residents of other states, ASK will make an incident-specific determination under the law that applies rather than rely on a single nationwide deadline.

6. Phishing and Impersonation

ASK will not ask you to disclose your password by email. Exercise caution with unexpected requests for payment, account credentials, wire transfers, cryptocurrency, gift cards, or sensitive information.

Messages purporting to be from ASK that appear suspicious should be forwarded to support@asktheconsultants.com.

LEGAL DISCLAIMER

7. No Professional Advice

Site content is general information about ASK and its network. It is not legal, financial, accounting, tax, investment, insurance, medical, cybersecurity, employment, or other professional advice and is not a substitute for advice from a qualified professional familiar with your circumstances.

Reading or using the Site does not create a professional or fiduciary relationship with ASK.

8. Meaning of Admission

Admission reflects ASK’s private evaluation under its own standards at a particular time and the provider’s continued status under ASK’s membership process.

Admission is not a certification, accreditation, license, governmental approval, professional credential, warranty, endorsement, fiduciary recommendation, ranking, or guarantee.

ASK does not warrant the competence, honesty, licensing, insurance, financial condition, security, regulatory compliance, availability, performance, conduct, or outcome of an admitted provider.

ASK’s evaluation uses information and judgment available at the time. Information can be incomplete, inaccurate, falsified, misunderstood, delayed, misidentified, or changed after review. Government records, court records, licensing databases, business registries, references, public internet sources, and other third-party sources may contain errors or may not reflect later events. Human and automated evaluation methods can make errors. The SCA evaluates business-behavior and professional-readiness characteristics; it is not a medical, psychiatric, psychological-health, disability, or clinical assessment and is not intended to diagnose or infer a health condition. No review eliminates business or professional risk.

ASK’s automated assessment technology may determine whether an applicant meets the SCA threshold. Applicants who do not meet the threshold do not advance for that intake. For applicants who meet it, ASK’s reviewers examine results the system flags for human attention and may review any other result before ASK decides whether to extend a conditional offer. Automated assessment does not independently grant membership.

8.1 Point-in-Time Evaluation; No Continuous Monitoring Duty

Admission, verification, compliance checks, complaint review, and other network-quality activities are point-in-time risk-management processes for ASK’s internal admission and network-management purposes. Unless applicable law requires otherwise or ASK expressly agrees in writing, ASK does not undertake a duty to continuously monitor, investigate, supervise, re-screen, re-verify, or discover every change concerning every provider, owner, employee, contractor, license, registration, insurance policy, financial condition, public record, complaint, or other circumstance.

ASK’s decision to investigate, verify, request information, monitor, suspend, or act in one instance does not create a continuing duty to do so in another instance. A provider’s continued listing or good-standing status is not a representation that no undiscovered or later-arising issue exists.

9. Your Due Diligence

Before engaging a provider, you remain responsible for your own decision and for independently confirming matters important to you, including licensing, registration, insurance, conflicts, references, professional discipline, scope, price, contract terms, confidentiality, data security, and remedies.

10. Membership Mark

An admitted provider may be permitted to display an ASK membership mark while in good standing. Display of the mark is optional.

The mark means only that the provider is a current admitted member at the time the mark is validly displayed. It does not mean “ASK Certified,” “ASK Recommended,” “Top Provider,” “Approved by ASK” in a governmental or professional sense, or any similar statement of guaranteed quality.

11. No Referral, Brokerage, or Agency Role

ASK does not route, assign, match, or steer a user to a particular provider and does not receive a commission, success fee, percentage, or transaction fee from provider client engagements.

Providers may independently make voluntary introductions to other providers. Those decisions belong to the provider and client. ASK does not require reciprocal referrals, set referral quotas, or make a specific referral a condition of membership.

ASK is not the agent, partner, joint venturer, employer, professional supervisor, or fiduciary of an admitted provider or client.

12. No Franchise or Earnings Representation

ASK membership is participation in a private professional network, not the purchase of a franchise, business format, exclusive territory, or promise of a business opportunity.

ASK does not prescribe a provider’s overall method of operation and does not promise leads, customers, market share, revenue, profits, return on investment, or earnings.

13. Listing Information

Provider listing content is supplied or approved by the provider and remains the provider’s responsibility. ASK may review or format listing content but does not continuously verify every statement.

ASK may correct, suspend, edit, or remove content without implying that ASK guarantees everything that remains published. ASK does not promise that every listing, license, insurance statement, ownership fact, disciplinary record, or other provider detail is continuously re-verified or updated in real time.

14. Not a Party to Provider Engagements

ASK does not negotiate, price, supervise, manage, deliver, or guarantee provider services. Any contract for provider services is between the client and provider.

Disputes concerning provider work, payment, deliverables, professional duties, or results are disputes between the client and provider, subject to their own contract and applicable law. ASK does not hear, mediate, arbitrate, or settle them.

When a user leaves the ASK Site or communicates directly with a provider through the provider’s website, email, telephone number, intake form, scheduling system, payment system, file-sharing system, or other provider-controlled channel, information supplied through that channel is provided to the provider and is subject to the provider’s own privacy, security, retention, professional, and legal obligations. ASK does not control the provider’s subsequent handling of that information merely because the provider was located through ASK.

15. Complaints

ASK may receive information about provider conduct for network quality purposes. ASK is not a regulator, court, arbitrator, mediator, claims administrator, or insurer for provider disputes and does not promise to investigate or resolve every complaint.

ASK may act on information in its lawful business discretion and may keep internal review material confidential to the extent permitted by law. A decision to review, investigate, or act on one complaint does not create a duty to investigate every complaint, continuously monitor the provider, discover unreported misconduct, reach the same result in another matter, or provide a complainant with ASK’s internal findings. Any membership action concerns ASK’s private network relationship and is not an adjudication of civil, regulatory, or professional liability.

16. External Links and Third Party Services

Links, embedded services, and third party content are operated by third parties. ASK is not responsible for their accuracy, availability, privacy, accessibility, security, or transactions. A link does not itself constitute endorsement. ASK does not warrant that third-party websites, APIs, hosting services, communication systems, payment systems, analytics tools, AI services, or other vendor systems will remain available, compatible, secure, error-free, or unchanged.

17. Forward Looking Statements

Statements about planned states, categories, features, provider capacity, launch dates, technology, marketing channels, advertising plans, network growth, or future operations reflect present intentions and may change. Unless a statement is expressly incorporated into a binding agreement, it is not a promise that ASK will implement or maintain a future plan or produce a particular level of traffic, exposure, inquiries, leads, revenue, or return on investment.

18. Accessibility

ASK seeks to make the Site usable by a broad audience and uses recognized accessibility guidance as an operational target. Accessibility is an ongoing process, and ASK does not represent that every page or feature has been independently certified to conform to a particular technical standard unless an audit supports that statement.

If you experience an accessibility problem, contact support@asktheconsultants.com and identify the page and barrier. ASK will work in good faith to provide reasonable access to the information or function through an alternative method where appropriate.

19. Trademarks and Intellectual Property

Ask The Consultants™, associated logos and marks, Precision Logic Architecture™, the Strategic Compatibility Assessment, and related proprietary materials are owned by ASK or its licensors.

No Site access grants permission to use an ASK mark except under a written license. Current admitted providers may use an approved membership mark only in accordance with the Terms and ASK’s usage standards.

20. United States Focus

ASK operates in the United States and does not intentionally market provider membership outside the United States. A person accessing the public Site from another jurisdiction is responsible for laws applicable to that person’s conduct, subject to any law that applies to ASK regardless of this statement.
